How much will an Illinois disability lawyer charge for a Social Security disability case?
In Social Security disability cases, most Illinois disability lawyers offer a “contingent fee” arrangement. A contingent fee is paid to the attorney only if they win your case. The usual fee is 25% or one-quarter of back benefits up to a maximum amount of $6,000, which is set by the Social Security Administration. The fee is derived from the benefits that have built up by the time you are found disabled and benefits are paid. No fee comes out of your current monthly benefits.
Ordinarily, the usual fee will not exceed the cap of $6,000, but if your lawyer has to appeal after the first administrative law judge hearing, your retainer agreement may call for a fee greater than $6,000. Even if this happens, your fee is unlikely to exceed 25% of back benefits.
In addition to the contingent fee, many attorneys will expect you to pay the costs of gathering medical records, obtaining medical opinion letters, and so on.
